Building Code Board of Examiners & Appeals

The Building Code Board of Examiners and Appeals (BCBA) provides an opportunity to request a variance including financial hardship or an opportunity to receive a final extension of time for completing repairs to code violations.

To have an appeal heard, submit a Building Code Board of Appeals Application along with the filing fee. The application must be filed with the Department of Neighborhood and Economic Operations.

Individuals are notified of the date and time of their hearing. If an appeal for extension is not granted, a Civil Infraction Violation and Notice of Hearing is issued to appear before the Administrative Hearings Bureau (AHB).

The BCBA must be made up of at least five members and include a building contractor, an architect or engineer, two members of the general public and one registered building official.
